Sport Horizon Insights – Terms & Conditions / Service Level Agreement (SLA)

1. Service Overview

Sport Horizon Insights (“we”, “our”, “us”) provides a software-as-a-service (SaaS) product that connects to third-party sport performance data providers, stores client data securely, and delivers performance dashboards to customers (“you”, “your”, “the Client”).

2. Service Access & Use

  • You are granted a non-exclusive, non-transferable licence to access and use Sport Horizon Insights for the duration of your subscription.

  • All rights to the underlying software and platform remain the property of Sport Horizon Insights.

  • Any intellectual property (IP) you create using our services (e.g., your dashboards, your reports) is owned by you.

  • You may not copy, distribute or reverse engineer our platform.

  • You must not use the service for unlawful purposes or in a way that breaches applicable laws.

  • You are responsible for maintaining the confidentiality of your API keys, tokens, and access credentials.

3. Data Privacy & Security

  • All client data is physically stored in Germany, ensuring adherence to EU data sovereignty laws (e.g., GDPR).

  • Our hosting and infrastructure is:

    • ISO 27001 certified (information security standard)

    • GDPR-compliant by design

    • BDSG (German Federal Data Protection Act) aligned

  • Data is encrypted both in transit (TLS/SSL) and at rest (SQL Server encryption).

  • Access to your data is restricted through token-based authentication, API keys, and role-based permissions.

  • Servers are single-tenant — no shared hardware or databases with other clients.

  • All database and API access is logged for security and compliance.

  • You retain ownership of your data at all times.

  • You grant us permission to process your data for the sole purpose of providing the service.

  • We may process anonymised, non-identifiable data derived from your usage to improve our services, in compliance with applicable privacy laws.

4. Client Responsibilities

  • You must provide a valid API key from your third-party data provider (e.g., GPS provider) to enable us to deliver the service.

  • You are responsible for ensuring the accuracy of your data inputs.

  • You are responsible for obtaining any necessary rights or permissions to use third-party data within our service.

5. Service Level & Availability

  • The service is provided on a rolling monthly subscription basis unless otherwise agreed in writing.

  • Initial dashboards and workflows are typically delivered within 7 working days of receiving your API key.

  • We commit to a minimum 99% service uptime, excluding planned maintenance or circumstances beyond our control.

  • Support is provided via our designated communication channels (e.g., WhatsApp group, email).

6. Fees & Payment Terms

  • Fees are charged monthly in advance by direct debit or invoice (depending on your arrangement).

  • We reserve the right to adjust subscription fees with 30 days’ written notice.

7. Termination

  • You may cancel your subscription at any time by giving 30 days' written notice.

  • We reserve the right to suspend or terminate your access for non-payment or breach of these terms.

8. Limitation of Liability

  • We will not be liable for any indirect, incidental, or consequential damages arising from the use of our service.

9. Governing Law

  • These Terms & Conditions are governed by the laws of England and Wales.

  • Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
